Terms and conditions

Rental Agreement: Terms & Conditions

This Rental Agreement (the "Agreement"), together with your booking confirmation, inspection photos and reports, checklists, and any addenda, is a binding contract between Coastal Trailer & Equipment Rentals LLC ("Coastal," "we," "us") and the renter ("you"). By booking online, accepting at checkout, or taking possession of any Rental Item, you agree to this Agreement.

1. Definitions

"You" means the renter named in the booking, anyone who accepts this Agreement, any Authorized User, and anyone responsible for payment, all jointly responsible. "Authorized User" means a person we approve to tow or operate a Rental Item. "Rental Item" means each trailer, skid steer, attachment, accessory, key, lock, strap, ramp, or other item in your booking. "Rental Period" begins at pickup or delivery and ends only after the item is returned (or retrieved), inspected, and accepted by us. "Charges" means rental fees, taxes, add-ons, and any fees or costs owed under this Agreement. "Loss of Use" means lost rental income while an item is out of service because of damage, theft, repair, or cleaning arising from your rental.

2. Ownership; condition

Rental Items remain our property at all times. Items are provided AS IS, and we make no warranties except those required by law. If an item is abandoned, overdue, used unlawfully, or used in violation of this Agreement, we may recover it without prior notice at your expense, where permitted by law. Some items have GPS trackers and electronic locks for theft recovery, maintenance and access; by renting, you consent to this monitoring.

3. Your responsibilities and representations

  • All information you give us is true, and you will provide a valid driver's license and proof of insurance at checkout.

  • You will use each item only for its intended purpose, within its rated capacity, following the manufacturer's guidance and our instructions, and in compliance with all laws.

  • You had a chance to inspect the item and ask questions before use.

  • You will not let anyone other than an Authorized User tow, operate, or use the item.

4. Pickup, delivery, and return

  • Trailers are self pickup and return at our lot at 132 Peanut Rd, Hampstead, NC, contact-free 24/7. Your lock code is for your rental only. Do not share it. Take before and after photos in Lockii at pickup and return. Return the trailer to the same spot, on time, with the lock secured.

  • Skid steers and U-Fill We-Dump are delivered. You must give us the job-site address, gate code, and drop spot, and make sure our truck and trailer can safely reach and leave the site. If we can't access the site, a trip charge may apply.

  • Return each item and all accessories on time, in the same condition, ordinary wear excepted, and free of trash, excessive dirt or mud, and debris. Cleaning fees apply (see Section 9). You remain responsible until we complete inspection.

  • No repairs, alterations, or part replacements without our approval.

5. Skid steer rules (Kioti TL750, Kubota SVL75-3, Kubota SCL1000 mini)

  • Operators must be 25 or older with a valid driver's license, and must know how to safely operate the machine or have received our walkthrough. Stop and call us if you are unsure.

  • Each rental day includes 8 engine hours. Extra hours are $50 per hour for the Kioti TL750 and Kubota SVL75-3, and $30 per hour for the Kubota SCL1000 mini. We record the hour meter at delivery and pickup.

  • Return the machine full of diesel, or pay $6 per gallon to refill. Prepaid fuel is available at checkout: $75 for the Kioti TL750 and Kubota SVL75-3, $35 for the Kubota SCL1000 mini. Use only clean diesel. Never add DEF or any other fluid to the fuel tank.

  • You must call NC 811 before any digging. You are responsible for damage to buried utilities, irrigation, septic, and other underground items.

  • No riders. Do not operate on unsafe slopes, near drop-offs or open water, in flooded areas, or on unstable ground. Keep people and pets clear of the work area. With the Extreme Tree Reaper, keep everyone at least 300 feet away while it is running.

  • Attachments: pallet forks, grapple, CMP Hydra Bucket, Extreme Tree Reaper (Kioti TL750 only), and Mini Grapple 42" (SCL1000 only). Use only attachments we provide, on the machines they're approved for, for their intended purpose.

  • If a warning light comes on, a hose leaks, a track comes off, or anything breaks, stop immediately and call (910) 994-4848. Do not attempt repairs.

  • You are responsible for damage to the job site and surrounding property caused by the machine, including driveways, lawns, landscaping, fences, and structures.

6. Trailer rules (dump, utility, car hauler, equipment)

  • Your tow vehicle must be rated to tow the loaded trailer, with the correct ball and hitch, working lights, and a working brake controller where required.

  • Never exceed the trailer's rated capacity (GVWR) or load it unevenly.

  • Dump trailers: no hazardous waste, chemicals, liquids, batteries, tires, asbestos, or loads heavier than the trailer is rated for (such as solid concrete or wet dirt piled high). Disposal and dump fees are your responsibility.

  • Secure and tarp every load as required by law. You are responsible for anything that falls from the trailer.

  • If you get a flat tire or have a roadside problem, call us right away. Do not continue towing on a flat or damaged tire.

7. Prohibited uses

These are material breaches and may result in immediate termination, recovery of the item, and full responsibility for resulting loss: use by anyone not authorized; use under the influence of alcohol or drugs; exceeding rated limits; reckless or illegal use; hauling hazardous or prohibited materials; tampering with or removing safety equipment, decals, locks, or GPS trackers; subletting or re-renting; and continuing to use an item after discovering damage or an unsafe condition.

8. Risk of loss and insurance deductible

From pickup or delivery through return or retrieval, you are responsible for safeguarding the equipment and for loss or damage caused by operation, misuse, neglect, theft, vandalism, fire, water, rollover, tip-over, collision, transport, unauthorized use, site conditions, or failure to perform required care. You must stop use, prevent further loss, notify us immediately, and make any appropriate police or emergency report.

If Coastal elects to submit a covered occurrence to its insurer and coverage is accepted, you pay the actual covered loss up to a maximum $2,500 deductible per occurrence. If the loss is less, you pay only the actual covered loss and lawful charges. The deductible is not a damage waiver or liability cap. You remain fully responsible for uninsured or excluded loss, amounts denied because of your conduct or breach, and other amounts due. Coastal is not required to submit a claim.

By accepting this Agreement, you acknowledge the deductible can be up to $2,500 per occurrence and is not a waiver or liability cap.

9. Damage calculation and fee schedule

You owe commercially reasonable inspection, diagnosis, recovery, transport, cleaning, repair, testing, parts, labor, taxes, shop supplies, and replacement cost less salvage when repair is not reasonable. You also owe reasonable Loss of Use during actual repair or replacement, subject to mitigation and normally capped at 30 rental days per occurrence. Ordinary wear is gradual deterioration from proper use; it does not include breakage, puncture, bending, contamination, missing parts, abuse, or failure to follow instructions. The ranges below are examples. Final charges rely on inspection, labor records, parts pricing, estimates, invoices, or replacement cost. 10. Charges and payment

No security deposit is required. You authorize us to keep your payment method on file and to charge it for amounts due under this Agreement, including rental extensions, add-ons, extra engine hours, fuel, cleaning, damage, Loss of Use, recovery and towing, tolls and violations plus a reasonable administrative fee, and collection costs and reasonable attorneys' fees where permitted. Charges are subject to final inspection. If more charges are found after the rental closes, we will notify you and you authorize us to charge them. Cancellations and refunds are handled under our Cancellation Policy.

11. Weather

Once a skid steer or other item has been delivered or picked up, weather conditions do not reduce the Charges.

12. Your property; job site

We are not responsible for personal property left in or around a Rental Item. You are responsible for site conditions, access, and damage to property at your job site, including underground utilities.

13. Fines, tolls, and violations

You are responsible for tolls, parking or moving violations, impound fees, fines, and similar charges during the Rental Period. If we pay any on your behalf, you authorize us to charge your payment method for the amount plus a reasonable administrative fee.

14. Breakdown

If an item stops working due solely to normal mechanical failure (not misuse, overload, accident, or neglect), our only responsibility is to provide a comparable replacement if available or refund the unused portion of the rental.

15. Assumption of risk and release

Towing trailers and operating heavy equipment involve inherent risks, including serious injury, death, and property damage. You voluntarily accept these risks for yourself and each Authorized User. To the fullest extent permitted by law, you release Coastal and its owners, employees, and agents from claims arising from your use of a Rental Item, except to the extent caused by our gross negligence or willful misconduct.

16. Insurance

You must provide proof of insurance at checkout, and keep any insurance required by law in force for the entire Rental Period, including auto liability insurance for any vehicle towing a trailer. We do not provide liability insurance for your use of Rental Items.

17. Indemnification

You agree to defend, indemnify, and hold harmless Coastal and its owners, employees, and agents from claims, damages, injuries, losses, attorneys' fees, and expenses arising from your possession, transport, operation, or use of any Rental Item or your breach of this Agreement, except to the extent caused by our gross negligence or willful misconduct.

18. Default and remedies

If you fail to pay, breach this Agreement, or abandon an item, we may terminate the rental, recover the item, and pursue any remedy available by law.

19. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages or lost profits arising from this Agreement or your use of Rental Items.

20. Personal information and messages

We use your information to process your rental, verify identity, recover items, collect amounts owed, and comply with law, as described in our Privacy Policy.
